Evaluation is Not Warranted

Notification:
Within fifteen (15) days of the evaluation-planning meeting, the parent (adult student, when applicable) must be provided with:

1. Written notice of the determination that the evaluation is not warranted.

2. A copy of the short procedural safeguards statement (SPSS).

3. Copies of the special education rules (N.J.A.C. 6A:14) and the due process hearing rules (N.J.A.C. 1.6A)

Parent Disagreement:

The parent (adult student, when applicable) may disagree with the determination by requesting mediation or a due process hearing.
